1. The owner of the website www.kunstkot.be and web store is Sanderdewilde.com, Boulevard Emile Max 28, 1030 Schaerbeek, BE0811046791 (tel +32495793922) info@sanderdewilde.com further referred to as KUNSTKOT.
2. Orders in the store can be placed via website.
PERSONAL DATA
1. The placement of the order is equivalent to agreeing to the processing of the Buyer's personal data by Foto4art and for the preparation of the invoice without the signature of the Buyer.
2. The Buyer's personal data, protected in accordance with the law on the protection of personal data, will not be transferred, sold or given on loan to other persons or authorities. The inclusion of the above-mentioned data is necessary in order to ensure the fulfilment of the Buyers' orders.
3. Only the owner of the website and web store has access to personal data.
EXECUTION OF ORDERS
1. The prices indicated in the web store are gross retail prices in Euro.
2. The acceptance of the rules and regulations and the correct completion of the order form by the Buyer, which can be found on the pages of the web store, constitute the condition of the execution of the purchase.
3.KUNSTKOT reserves the right to refuse the execution of the order if it raises doubts, e.g. if the order is placed with incorrect execution options. In such a case Foto4art will contact the Buyer in order to correct the order.
4. If the Buyer does not confirm the order within 7 working days, the order will not be executed.
5. The Buyer is required to provide his e-mail and telephone contact number under which the confirmation of the order is possible.
6. The Buyer has the possibility to cancel the order under the condition that its execution has not started - the cancellation must be made through contact with Foto4art (by the communication channels proposed in the web store) and confirmation of the cancellation by KUNSTKOT.
7. The execution time (production time) of the order is counted, from the moment the customer receives the message notifying that the order is in production. The products will be manufactured and shipped within the period indicated on our website (see "delivery times").
8. The execution of the order consists in the manufacture of the painting for the customer according to the order form and the specification provided by him in accordance with execution options; the execution includes print of the painting on canvas, stretched on the stretcher, packaging and dispatch.
9. The manufactured product will be delivered to the customer by a courier service, at the address specified in the order form. The shipping costs depend on the product ordered as well as on the formats ordered (see "shipping costs"). It is also possible to collect the ordered product in person, subject to prior agreement.
10. The orders which are not confirmed within 7 days (by payment on account of the value of the order or by telephone confirmation), will be cancelled.
11. The price indicated for each product is binding at the time the order is placed by the customer. KUNSTKOT reserves the right to change the prices of the producer in the offer, to introduce new products in the offer of the web store, to implement promotional actions on the pages of the web store or to abolish or modify them.
12. A VAT invoice will be prepared for each order. The VAT invoice will be made at the time when all goods ordered by the Customer are complete and ready for shipment.
13. Payment for goods shall be made by prepayment to the bank account of KUNSTKOT obtained during confirmation of purchase.
14. The buyer is obliged to check the contents of the shipment in the presence of the courier. If the packaging and/or goods have been damaged during transport, this must be stated on the delivery note. Without this statement, complaints are unfortunately not possible. Any defects in the delivered goods must be reported to our customer service immediately upon receipt to ensure a smooth handling.
15. For deliveries within the European Union, the VAT rates of the country of arrival apply. For deliveries outside the European Union, with the exception of the United Kingdom*, the VAT rate of the country of origin, i.e. Belgium (21%), applies. VAT-free purchases are only possible for companies established outside Belgium. Please enter your VAT number during the payment process.
*For deliveries to the UK, the local VAT rate of 20% applies. For purchases up to £ 135, VAT will be calculated during the purchase process and shown on the sales invoice. For purchases over £135, VAT will be charged on the purchase invoice.
Refund Policy: a. Workshop Cancellation by Kunstkot: i. In the event that Kunstkot cancels a workshop, participants will be entitled to a full refund of the workshop fee. ii. Participants will be notified as soon as possible regarding the cancellation, and the refund will be processed within 14 days of the cancellation notification.
b. Participant Cancellation: i. If a participant wishes to cancel their registration for a workshop, the following refund policy will apply: - Cancellation more than 14 days before the workshop date: Full refund of the workshop fee. - Cancellation between 7 to 14 days before the workshop date: 50% refund of the workshop fee. - Cancellation less than 7 days before the workshop date: No refund will be provided.
Risks and Liability: a. Participation in workshops organized by Kunstkot may involve certain inherent risks, including but not limited to physical injuries or damage to personal property. b. By participating in a workshop, participants acknowledge and assume all risks associated with the activity. Kunstkot will not be liable for any injuries, accidents, losses, or damages that may occur during the workshop.
Workshop Content and Materials: a. Kunstkot reserves the right to modify the content, schedule, or materials used in a workshop, if deemed necessary, without prior notice. b. All workshop materials provided by Kunstkot remain the intellectual property of the company and may not be reproduced, distributed, or used for commercial purposes without written consent.
Participant Conduct: a. Participants are expected to conduct themselves in a respectful and appropriate manner during the workshop. b. Kunstkot reserves the right to remove any participant from a workshop if their behavior is deemed disruptive, offensive, or harmful to others, without providing a refund.
Photography and Promotion: a. Kunstkot may take photographs or videos during workshops for promotional purposes. By participating in a workshop, participants grant Kunstkot the right to use these images or videos for marketing and promotional materials.
Age Restrictions: a. Some workshops may have age restrictions or specific requirements for participation. Participants must comply with these restrictions and requirements to join a workshop.
Personal Belongings: a. Participants are responsible for their personal belongings during the workshop. Kunstkot will not be liable for any loss, theft, or damage to personal items.
